1. Game of Skill: The ULTIMATE SURVIVOR CHALLENGE is a game of skill in which participants use their knowledge and analysis of professional football, and the skills and strategies surrounding the rules governing the ULTIMATE SURVIVOR CHALLENGE, to compete against other participants. Winners are determined by the objective criteria enumerated in the published rules.
2. Participants: By participating, individuals agree to abide by the terms, disclaimers and rules governing the ULTIMATE SURVIVOR CHALLENGE. Further, an individual may only enter the ULTIMATE SURVIVOR CHALLENGE once. If an individual enters more than once, they will forfeit claim to all prizes. No exceptions.
3. Co-Participants: Only one person will be considered the manager of a team in the ULTIMATE SURVIVOR CHALLENGE and any prize awards will be awarded solely to that one individual.
4. Ties: In the event of a tie for the determination of prizewinners, all tying teams will share equally in the prize awards. Namely, they would share equally the combined total of the spots they tied. Example: Two teams tie for 1st place. Then, they would equally split the awards for 1st and 2nd place. In this scenario, both team managers would be considered tied for first place, with the next highest point total as third place. When it is not possible to split prize awards (example a trip), a random drawing will occur to break the tie. In the event of a tie for the determination of survivor elimination, all teams at the cutoff number will be eliminated.
5. Entry Deadline: The deadline to submit/edit your team entry is September 6th (1PM ET).
6. Eligibility: The ULTIMATE SURVIVOR CHALLENGE is open to all legal residents of the 50 United States,
Washington D.C. and Canada 21 years of age or older that meet all the following requirements.
To be eligible you must be a subscriber and 21 years of age or older.
Because each state has its own laws, and some are
vague regarding Fantasy Football, residents of Arizona, Iowa, Louisiana, Montana and Vermont,
are not eligible to win prizes but may submit a team
and follow their team's progress during the competition.
Unfortunately, these state restrictions must apply to protect all involved with this
4for4.com subscriber's bonus game offering. Also, those that live in areas where this
contest is prohibited by local law are not eligible (void where prohibited by law).
Employees and immediate family members of 4for4.com, its sponsors,
affiliates and subsidiaries are not eligible to win prizes. Immediate family is
defined as parent, sibling, or any other person residing in the same household.
The terms employees and affiliates includes all
paid site content contributors and any other
individuals providing services to 4for4.com in calendar year 2007.
Contestants must have and supply their own access to a computer and the Internet to manage their teams.
7. Cancellation: In the very unlikely event the ULTIMATE SURVIVOR CHALLENGE is cancelled because of an act of terrorism, or any unforeseen catastrophe, or an Act of God, then 4for4.com is not responsible for any loss or liability incurred by any participant due to the cancellation.
8. NFL Scheduling: If for any reason, the National Football League amends any portion of its regular season schedule, 4for4.com reserves the right to determine prizewinners based on an amended ULTIMATE SURVIVOR CHALLENGE system and reserves the right to make any and all reasonable scheduling and changes if the NFL alters its schedule. In the event that the NFL cancels any part of its regular season schedule, 4for4.com reserves the right to determine ULTIMATE SURVIVOR CHALLENGE prizes based on the NFL games already played. Term of the 2007 ULTIMATE SURVIVOR CHALLENGE: Begins three days before the first 2007 NFL regular season game and ends thirty days after the last game of NFL Week #16 (spanning the first 16 weeks of the NFL season).
9. Contest Management/Commissioner: The ULTIMATE SURVIVOR CHALLENGE software was designed to keep track of
reporting, starting lineup submissions, fantasy point calculations and rankings.
The software is also designed to show you if you are within the $100million Salary Cap while you
are building your team. However, it is still your responsibility to submit a team that is valued at $100 million or less,
otherwise your team will be disqualified.
All NFL player scoring will be determined by 4for4.com and it’s ruling will serve as the standard for all scoring. Players on a bye week have no statistics. 4for4.com will serve as the Commissioner of the ULTIMATE SURVIVOR CHALLENGE as it relates to decisions and rulings regarding the contest.
10. Scoring Discrepancies: Any and all scoring discrepancies affecting a team must be noted and submitted via email to the ULTIMATE SURVIVOR CHALLENGE Commissioners by midnight ET on the Tuesday following the completion of that week’s games. After 6:00 PM ET on Wednesday of any given week, all scores will be considered final. It will be up to the sole discretion of 4for4.com as to whether a change in the official statistics of a player can reasonably be applied to amend the ULTIMATE SURVIVOR CHALLENGE rankings or scoring of any or all teams potentially affected by the change in a player’s statistics.
11. Disputes/Appeals Regarding Rules: Any disputes or appeals regarding the ULTIMATE SURVIVOR CHALLENGE Official Rules will be decided by 4for4.com using its interpretation of the rules. 4for4.com will consider the intent and spirit of the rules; the integrity of the ULTIMATE SURVIVOR CHALLENGE; as well as the feasibility of accommodating any appeal. All rulings made by 4for4.com are final and binding.
12. Prize Notification: Winners will be notified by email within 30 days after the overall results are posted on the 4for4.com web site at the conclusion of the tournament. Winners must return via email or regular mail an affidavit of eligibility and provide some basic information such as name, phone number and mailing address, if prize needs to be mailed, within 15 days following attempted notification. Failure to comply or to keep your valid email on file to fulfill this requirement can result in disqualification. Winners agree to have their name and prize awards announced at 4for4.com. The Grand Prize winner also agrees to submit their photo 15-days after notification and have it posted on the 4for4.com web site. Any prize notification returned as undeliverable may result in disqualification and selection of an alternate winner. By accepting a prize, the winner grants permission to 4for4.com to use their names and/or likenesses for publicity and promotional purposes without further compensation, unless prohibited by law.
13. Prize Money: All prize money will be mailed out within 30 days after the overall results are posted on the 4for4.com web site at the conclusion of the tournament. Winners of over $600 dollars cash will be required to return a W9 form before their prize money can be mailed out. Any interest accrued to prize money does not convey to the prize winner. Any non-cash prizes may be substituted by cash, or by a prize of equal value at the sole discretion of 4for4.com. No substitution or transfer of prize is permitted. All prizes are awarded "as is" and without warranty of any kind including, without limitation, any implied warranty of merchantability for a particular purpose.
14. Survivor Cutoff: The cutoff is stated as a percentage in the rules. 4for4.com will round this number up if needed to make the number of teams eliminated a whole number.
15. Taxes: Winners receiving $600.00 or more agree to submit their valid and legal social security number to 4for4.com and winners understand that their social security numbers will be used to report income to the Internal Revenue Service. All taxes associated with the receipt of any prize are the sole responsibility of the winner. A form 1099-Misc will be issued to all prizewinners receiving $600.00 or more.
16. Participants’ Proprietary Information: Any proprietary information given to the ULTIMATE SURVIVOR CHALLENGE participants, including but not limited to an internet password to access the ULTIMATE SURVIVOR CHALLENGE tournament website, shall be kept confidential by both 4for4.com and the participant. 4for4.com will not be responsible for any changes made to account information, or the roster or starting line up by third parties or co-team managers who access the ULTIMATE SURVIVOR CHALLENGE website.
17. Internet/Technology Problems: 4for4.com is not responsible if the Internet portion of the ULTIMATE SURVIVOR CHALLENGE is not capable of running as planned, for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of 4for4.com which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this tournament. 4for4.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation, faulty transmission or communication, line failure, theft, destruction, or unauthorized access to tournament activities conducted or information transmitted via the Internet or the telephone. 4for4.com is not responsible for a customer's PC configuration and PC setting that may interfere with the ULTIMATE SURVIVOR CHALLENGE software. Further, 4for4.com is not responsible for any problem or technical malfunction of any telephone network, telephone line, cable network, PC, cable, computer on-line system, server, equipment, or software. 4for4.com is not responsible for the failure of any e-mail or entry or change to be applied to a customer's account due to technical problems or traffic congestion on the Internet or at any web site, phone or fax lines, or any combination thereof, including any injury or damage to a customer's computer related to or resulting from participation in the ULTIMATE SURVIVOR CHALLENGE (including without limitation, damages by virus).
18. Team Management Disclaimer: 4for4.com is not responsible for any problem or technical malfunction which impedes or interferes with the transmission or receipt of any team transaction, including but not limited to starting lineup submissions. 4for4.com is not responsible for the failure of any telephone network or lines, computer online systems, servers, equipment or software, or traffic congestion on the Internet or at any web site, phone lines, or any combination thereof, including any injury or damage to a participant's computer related to or resulting from participation in the ULTIMATE SURVIVOR CHALLENGE.
19. Collusion: 4for4.com believes collusion is a non-issue in the ULTIMATE SURVIVOR CHALLENGE. That said, any participants who collude or attempt to collude in an effort to alter the standings, rankings, or fantasy point totals will be prohibited from winning any prize. Any participant who attempts to bribe, coerce, blackmail or otherwise influence an officer, agent, affiliate, vendor or surrogate of 4for4.com in an effort to alter the standings, rankings, or fantasy point totals will be prohibited from winning any prize. Any criminal behavior by a participant which attempts to corrupt or alter the fairness of the ULTIMATE SURVIVOR CHALLENGE will result in civil and/or criminal prosecution.
20. Event Tampering: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE ULTIMATE SURVIVOR CHALLENGE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE ULTIMATE SURVIVOR CHALLENGE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND IN THE EVENT THAT AN ATTEMPT BE MADE, FANTASY TOURNAMENTS LLC RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.
21. Disclaimers: 4for4.com is not responsible for any ULTIMATE SURVIVOR CHALLENGE disruptions, injuries, losses or damages caused by events beyond the control of 4for4.com and the ULTIMATE SURVIVOR CHALLENGE. Any printing or typographical errors in any materials associated with the ULTIMATE SURVIVOR CHALLENGE or any subsidiary, affiliated company, or vendor are not in any way responsible or liable for any damage, loss or injury (including death) resulting from any participant’s activity in the ULTIMATE SURVIVOR CHALLENGE and related events, and/or acceptance and use of any prize won. 4for4.com is solely responsible for enacting, administering, enforcing the rules, and maintaining the integrity of the ULTIMATE SURVIVOR CHALLENGE. The ULTIMATE SURVIVOR CHALLENGE and web site are not sponsored, affiliated or endorsed by the National Football League or the NFL Players’ Association. Further, this site is not endorsed by any current NFL player or team. By entering the contest, the entrant grants 4for4.com the right to use and publish the entrant's proper name, state or province of residence, score, and ranking online and in any other media in connection with the Contest, unless prohibited by law.
22. Exclusion: The parties hereby agree that in the event that there is an alleged breach of contract or alleged liability incurred, no party shall commence any proceedings or otherwise seek to impose any liability whatsoever against 4for4.com or its owners or affiliates and their respective directors, officers, employees and agents, by reason of alleged breach, default or claim.
23. General Release: By participating in the ULTIMATE SURVIVOR CHALLENGE, you release and agree to hold harmless 4for4.com, Pieracle Inc, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the “Released Parties”) from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the ULTIMATE SURVIVOR CHALLENGE or acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries and losses related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional, whether under a theory of contract, tort (including negligence), warrant or other theory.
24. Headers: The section headers contained herein are only provided for convenience purposes only and shall not be used to modify or interpret the terms of these Official Rules.
25. Severability: In the event that any provision of these Terms and Official Rules are found invalid or unenforceable pursuant to judicial decree or decision, the remainder of the Official Rules and Terms shall remain valid and enforceable according to its terms. The parties intend that the provisions of these Official Rules be enforced to the fullest extent permitted by applicable law. Accordingly, the parties agree that if any provisions are deemed not enforceable, they shall be deemed modified to the extent necessary to make them enforceable.
